The Activity That Puts Beginners In The Ocean With Minimal Training Has A Safety Record; The Record’s Existence Does Not Mean Regulation Is Unnecessary

CALIFORNIA — California requires surf instructors at beach concessions to hold specific certifications and maintains basic licensing requirements for surf school operations. Several other states with significant surf instruction industries have no equivalent requirements. The patchwork of regulation and non-regulation reflects the surf instruction industry’s political organisation — significant enough to have influenced California’s framework toward manageable requirements, insufficient to have produced national standards. The libertarian argument against regulation (the market will punish schools with poor safety records) has some merit: reputable schools maintain their reputations by not injuring students. It does not account for the first-time student who cannot assess the school’s safety record before selecting it.
