The Surf Initiative Pipeline: Phase 4 Is Enforcement

The Coastal Commission’s enforcement team has issued its first three Cease and Desist orders based on the Phase 3 inventory’s findings. Three blockages out of 847 identified. The enforcement rate is 0.35 percent of identified violations in the first month of Phase 4. The Commission’s communications team describes this as “the beginning of a systematic enforcement programme.” The surf community describes it as “what took four years to produce three letters.”

The libertarian observation: both descriptions are accurate. The enforcement programme has begun. The rate is slow. Both are true. The libertarian critique is not that enforcement has not begun but that the four-phase pipeline required four years to reach the beginning of enforcement against violations that were documented in Phase 1. A more direct enforcement mechanism — using the Phase 1 assessment data to issue enforcement actions rather than waiting for Phases 2-3 to produce the inventory — would have produced enforcement three years earlier. The law authorised enforcement in Phase 1. The pipeline deferred it to Phase 4. The pipeline’s procedural requirement deferred enforcement that the law had already authorised.
